These Terms of Service ("Terms") govern your use of Lyra.kids and our AI-powered story generation services. By accessing or using our services, you agree to be bound by these Terms.

Parental Consent and Children's Use

Lyra.kids is designed for children under 13 years of age. By using our services, you represent that:

• You are a parent or legal guardian providing consent for your child's use
• You understand that AI-generated content will be created based on user inputs
• You will supervise your child's use of the service

Use of Services

Our services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that our services will be uninterrupted, secure, or error-free.

User Accounts

When you create an account with us, you must provide accurate and complete information. You are responsible for safeguarding your account and for all activities that occur under your account.

Parents/guardians are fully responsible for all purchases and activities conducted through accounts created for their children.

Credits and Payments

Purchase of Credits

• Credits are purchased in packages and used to generate AI stories
• Credits never expire once purchased
• Credits are non-transferable between accounts

Refund Policy

Due to the nature of our credit-based AI service, our refund policy is as follows:

Eligible for Refund:

• 7-Day Unused Credits: Full refund available within 7 days of purchase if credits are completely unused
• Technical Issues: Credits will be refunded or restored if deducted due to system failures without successful content generation
• Duplicate Charges: Full refund for duplicate charges caused by payment system errors
• Unauthorized Purchases: Refund available within 48 hours of discovery if a child made an unauthorized purchase (proof of guardianship required; account will be reviewed)

Not Eligible for Refund:

• Credits that have been used (even partially)
• Credits purchased more than 7 days ago if any usage has occurred
• Dissatisfaction with AI-generated content (creative product characteristic)
• Account suspension or termination due to Terms violation

Refund Process: To request a refund, contact support@lyra.kids with your order number and reason. Approved refunds will be processed within 14 business days to the original payment method.

AI-Generated Content and Copyright

Nature of AI-Generated Content

All stories, images, and content generated through our service are created by artificial intelligence based on user inputs and prompts.

Copyright and Ownership

• Users retain ownership of content they generate using our service
• Users may use generated content for personal, non-commercial purposes
• We do not claim ownership of user-generated content

Copyright Disclaimer

IMPORTANT: While we strive to generate original content, AI systems are trained on large datasets and may inadvertently produce content that resembles existing copyrighted works.

We do not guarantee that AI-generated content is free from copyright infringement.

By using our service, you acknowledge that:

• AI-generated content may unintentionally resemble existing copyrighted material
• You are responsible for reviewing generated content before public use or distribution
• We are not liable for copyright infringement claims related to AI-generated content

Copyright Infringement Reporting

If you believe content generated or displayed through our service infringes your copyright:

1. Contact Us: Email support@lyra.kids with:

   • Your contact information
   • Description of the copyrighted work
   • URL or description of the allegedly infringing content
   • A statement of good faith belief that the use is not authorized
   • A statement that the information is accurate and you are the copyright owner or authorized to act

2. Takedown Process: We will review valid claims within 5 business days and remove content if infringement is confirmed

3. User Notification: If user-generated content is removed, we will notify the account holder

Intellectual Property

Our website, platform features, and functionality are owned by us and are protected by international copyright, trademark, and other intellectual property laws.

Prohibited Activities

You agree not to:

• Use our services in any way that violates any applicable law or regulation
• Generate content that is harmful, offensive, or inappropriate for children
• Attempt to circumvent credit requirements or payment systems
• Engage in any conduct that restricts or inhibits anyone's use or enjoyment of our services
• Attempt to gain unauthorized access to our servers or networks
• Use our services to distribute malware or other harmful code
• Use AI-generated content for commercial purposes without proper copyright verification

Content Moderation

We reserve the right to review, monitor, and remove any content that:

• Violates these Terms
• Is reported as inappropriate
• May infringe intellectual property rights
• Is harmful or unsuitable for children

Termination

We may terminate or suspend your account and access to our services immediately, without prior notice or liability, for any reason, including:

• Violation of these Terms
• Fraudulent activity or payment disputes
• Misuse of the service or generation of inappropriate content
• Upon request from parents/guardians for children's accounts

Upon termination, unused credits will be forfeited.

Limitation of Liability

In no event shall we be liable for any indirect, incidental, special, consequential, or punitive damages resulting from:

• Your use of or inability to use our services
• AI-generated content or copyright claims
• Loss of data or credits
• Unauthorized access to your account

Our total liability shall not exceed the amount you paid for credits in the 30 days prior to the claim.

Changes to Terms

We reserve the right to modify these Terms at any time. If we make changes, we will provide notice by posting the updated Terms on this page and updating the date above.

Continued use of our services after changes constitutes acceptance of the new Terms.
